TERMS & CONDITIONS 

1. Introduction

These Terms & Conditions govern all home healthcare services provided by Viraxs Healthcare (“Company”). By booking or using our services, the Client agrees to be bound by these Terms & Conditions.

2. Definitions

Company: Viraxs Healthcare.

Client: The person booking the service for themselves or for a patient.

Patient: The individual receiving care.

Staff: Caregiver, Patient Attendant, Elder Care Attendant or any healthcare support personnel assigned by Viraxs Healthcare.

Services: Home healthcare support, patient care, elderly care, caregiver services and other support services offered by the Company.

3. Scope of Services

Viraxs Healthcare provides trained support staff for home healthcare assistance.

Services may include:

– Patient Care Attendant

– Elder Care

– Bedridden Patient Care

– Post Hospitalization Assistance

– Mobility Assistance

– Personal Hygiene Assistance

– Feeding Assistance

– Daily Living Support

The Company does not guarantee medical recovery, diagnosis, prescription or treatment. All medical decisions shall remain the responsibility of the treating doctor.

4. Service Availability

Services are subject to:

– Staff availability

– Location coverage

– Client verification

– Payment confirmation

Viraxs Healthcare reserves the right to accept or decline any service request.

5. Client Responsibilities

The Client shall:

– Provide correct patient details.

– Share complete medical history.

– Inform about allergies, infections or contagious diseases.

– Provide a safe working environment.

– Inform immediately in case of any emergency.

– Cooperate with assigned staff.

Failure to provide accurate information may affect the quality of service.

6. Patient Responsibilities

The patient or family shall:

– Follow doctor’s medical advice.

– Arrange prescribed medicines.

– Arrange medical equipment if required.

– Inform staff regarding any sudden health changes.

7. Staff Responsibilities

Assigned staff shall:

– Perform only assigned duties.

– Maintain patient dignity.

– Respect client privacy.

– Follow professional behaviour.

– Inform the Company immediately regarding any emergency.

Staff shall not perform any medical procedure beyond their training or assigned role.

8. Duty Hours

Duty hours shall remain strictly according to the service agreement.

Extra work beyond agreed duty hours may attract additional charges.

9. Service Extension

If the Client wishes to extend the service, advance confirmation from Viraxs Healthcare shall be required.

Extension depends upon staff availability.

10. Payment Policy

New Clients

Advance payment is mandatory before service commencement.

Long-Term Services

Payment shall be made every 15 days in advance.

Example:

Service Start: 1st

Next Payment Due: 16th

Next Payment Due: 1st of following month

Accepted Modes

– UPI

– Bank Transfer

– Cash

Viraxs Healthcare reserves the right to suspend or discontinue services if payment remains overdue beyond 24 hours of the due date.

11. Salary Policy

The Client shall make payment only to Viraxs Healthcare.

The Company shall pay salaries to its staff as per its internal payroll policy.

Direct payment to staff without Company approval is prohibited.

12. Direct Hiring Restriction

The Client shall not directly hire, employ or engage any staff introduced by Viraxs Healthcare without prior written permission.

Violation may result in legal action and/or compensation as permitted by applicable law.

13. Replacement Policy

Replacement shall be considered only for genuine reasons including:

– Behavioural issues

– Medical emergency of staff

– Leave

– Performance concerns

Replacement will be arranged subject to staff availability, generally within 24–48 hours.

Replacement is not guaranteed in emergency situations or where no suitable staff is available.

14. Cancellation Policy

Client should preferably inform the Company at least 24 hours before cancellation.

Emergency cancellations shall be handled on a case-by-case basis.

Cancellation charges, if applicable, shall be communicated in advance.

15. Refund Policy

Registration Fee and Processing Fee are non-refundable.

Once services have commenced, payments are generally non-refundable unless otherwise approved by Viraxs Healthcare in writing or required under applicable law.

Approved refunds, where applicable, shall be processed within a reasonable time.

16. Medical Emergency

In case of any medical emergency, the assigned staff shall immediately inform the Client’s family, treating doctor, or emergency services, as appropriate.

Viraxs Healthcare and its staff shall not make independent medical decisions beyond their assigned role or professional qualifications.

17. Patient Death

Viraxs Healthcare shall not be held responsible for the death of a patient resulting from:

– Natural causes

– Age-related complications

– Pre-existing illnesses

– Chronic diseases

– Medical conditions beyond human control

– Decisions taken by the treating doctor or family

Death certificate, hospital formalities, police formalities, post-mortem (where applicable), insurance claims, and all legal procedures shall remain the responsibility of the Client, patient’s family, or legal guardian.

Viraxs Healthcare or its staff shall only be liable where negligence has been established by a competent court or authority under applicable law.

18. Staff Safety

The Client shall ensure a safe, respectful, hygienic, and harassment-free working environment for the assigned staff.

Any form of physical abuse, verbal abuse, sexual harassment, intimidation, discrimination, or unsafe working conditions may result in immediate withdrawal of the staff without prior notice.

19. Client Conduct

The Client shall not:

– Abuse or threaten staff.

– Force staff to perform duties outside the agreed scope.

– Ask staff to perform illegal activities.

– Withhold identity documents or personal belongings of staff.

Violation of these conditions may result in immediate termination of services.

20. Staff Conduct

Assigned staff are expected to maintain professional behaviour at all times.

Any complaint regarding misconduct should be reported to Viraxs Healthcare immediately.

The Company will investigate the matter and take appropriate action where required.

21. Confidentiality

Viraxs Healthcare shall make reasonable efforts to keep the Client’s and Patient’s personal and medical information confidential.

Information may be disclosed only:

– with the Client’s consent,

– where necessary for providing the service, or

– where required by law or a competent authority.

22. Valuables & Cash

The Client is solely responsible for safeguarding cash, jewellery, valuables, important documents, passwords, ATM cards, PINs, mobile phones, laptops, and other personal belongings.

Unless specifically agreed in writing, assigned staff shall not be responsible for handling or safeguarding such items.

23. Medical Equipment

The Client shall provide all prescribed medicines, medical equipment, consumables, and supplies required for patient care unless expressly agreed otherwise.

Viraxs Healthcare shall not be responsible for non-availability or malfunction of equipment supplied by the Client.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Viraxs Healthcare shall not be liable for:

– Indirect or consequential losses,

– Emotional distress,

– Loss of income,

– Business interruption,

– Medical outcomes beyond the Company’s control,

– Delays caused by traffic, weather, public restrictions, or circumstances beyond reasonable control.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

25. Indemnity

The Client agrees to indemnify and hold harmless Viraxs Healthcare, its directors, employees, and staff against claims, losses, damages, or expenses arising from:

– Incorrect information provided by the Client,

– Violation of these Terms,

– Misuse of services,

– Acts or omissions of the Client or Patient beyond the Company’s control,

except to the extent caused by the Company’s proven negligence.

26. Force Majeure

Viraxs Healthcare shall not be liable for any delay, interruption, or failure in providing services due to events beyond its reasonable control, including but not limited to:

– Natural disasters,

– Floods,

– Earthquakes,

– Fire,

– Pandemic or epidemic,

– Government restrictions,

– War,

– Civil unrest,

– Strikes,

– Transportation disruptions,

– Power or communication failures.

27. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, Haryana.

28. Changes to Terms

Viraxs Healthcare reserves the right to update or modify these Terms & Conditions from time to time.

Updated Terms shall become effective upon publication on the Company’s website or communication to the Client, as applicable.

29. Severability

If any provision of these Terms is held invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.

30. No Waiver

Failure by Viraxs Healthcare to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights available under law.

32. Client Declaration
